1. VALIDITY OF GENERAL TERMS AND CONDITIONS

The overarching Terms and Conditions outlined herein are binding for all services provided by ikoly pertaining to the resale of prepaid eSIMs, as detailed on the website https://www.ikoly.com. Any deviations from these terms will require explicit written consent for acceptance by ikoly.

ikoly will only consider alternative clauses with the explicit written agreement.


2. DESCRIPTION OF SERVICES

2.1. eSIM RESELLING

ikoly specializes in reselling prepaid eSIMs.

Customers can register and purchase SIM cards via the website https://www.ikoly.com and/or the ikoly App. Payments are processed through PayPal (https://paypal.com) and Stripe (https://ikoly.com) using a virtual credit card imprint.

2.2. REGISTRATION FOR USING ikoly SERVICES

To utilize ikoly services, the customer is required to agree to the General Terms and Conditions. When accessing the website https://www.ikoly.com, the client provides the following information directly on the web browser, either personally or through an intermediary service provider (such as a hotel or travel agency): First Name, Last Name, Billing Address, and Email Address.

2.3. ikoly ENGAGEMENTS

ikoly will make reasonable efforts to deliver quality service to the Customer. However, ikoly does not guarantee that the service will be uninterrupted, provided on time, or completely safe and free from faults.

2.4. CUSTOMER ENGAGEMENTS

When utilizing the Equipment or Services offered by ikoly, the Customer must refrain from any actions that are abusive, illegal, or fraudulent, and must also avoid actions that result in impairment or damage to the Network.

If the Customer violates its obligations according to Sec. 2.4, ikoly reserves the right to suspend the Customer's use of the Service. Throughout any suspension period, the Customer is still obligated to pay all Charges specified in this Agreement concerning the suspended Services.

2.5. DEVICE COMPATIBILITY

The Customer bears the responsibility to confirm that their device is eSIM compatible and network-unlocked. The compatibility of the device may vary based on the carrier and country of origin. It is essential for the Customer to review the list of eSIM-compatible devices provided at the checkout.

Upon checking the box to confirm the compatibility of the Customer's device with eSIM, the Customer assumes responsibility for the accuracy of the information provided.

The eSIM compatibility list is not comprehensive, implying that newly announced eSIM-compatible devices might require addition.


3. START, DURATION, AND TERMINATION OF THE CONTRACT

The service contract between ikoly and the Customer commences upon the completion of the order made on the ikoly website https://www.ikoly.com or through the ikoly app.

The responsibility for activating the eSIM and acknowledging the Activation Policy lies with the Customer.

The contract will be terminated if the Customer does not maintain an active data package or if the eSIM is removed from the designated device..

4. CHARGES AND PAYMENT

4.1. PAYMENT CONDITIONS

The supported payment methods for ikoly services are Credit/Debit Card, PayPal, Google Pay, Apple Pay,Stripe, Alipay .

The currency of payment is in Euro (€).

The credit card transaction will be handled and secured by ikoly through payment service providers PayPal (https://paypal.com) and Stripe (https://ikoly.com).

4.2. CHARGES FOR USE

4.2.1. VAT Inclusion

ikoly declares that all Charges include Value Added Tax (VAT) unless stated otherwise.

4.2.2. Claims and Offsetting

The Customer does not have the right to set off any of its claims against claims made by ikoly, unless the Customer's claims are undisputed or have been validated by a final court judgment.


5. DELIVERY

Upon purchase, the Customer will promptly find the acquired eSIM listed under the "My eSIMs" tab on the ikoly website https://www.ikoly.com and/or the ikoly app.

Following the purchase, the Customer will receive a confirmation email. However, all information regarding the eSIM installation will exclusively be accessible through the user's ikoly account.


6. REFUND / CANCELLATION / MODIFICATION POLICY

If the eSIM cannot be installed and used due to a technical issue originating from ikoly, the Customer retains the right to request either a refund or a replacement eSIM.

6.1. REFUNDS AND CANCELLATION

6.1.1. POLICIES AND GUIDELINES

A request for a refund can be submitted within thirty (30) days from the date of purchase in cases where activation becomes impossible after exhaustive collaborative troubleshooting.

6.1.2. Cooperation and Criteria

Collaboration with the Customer to promptly address the issue is necessary for a refund to be approved.

The validity of each data package varies. Once the validity period expires, no refunds will be provided for any remaining data.

No reimbursement or compensation will be provided for charges that are not directly associated with the Customer's ikoly eSIM account.

Refunds might be declined in instances of fraudulent or unauthorized purchases, as well as accidental purchases.

Concerns or disputes regarding charges must be reported within twelve (12) days upon receipt of the invoice.

Requests for refunds on eSIMs bought solely with Airmoney earned from vouchers can be made within 30 days from the purchase.

Any other refund requests will be individually assessed on a case-by-case basis and might incur a processing fee.

6.1.3. USE OF AIRMONEY

Airmoney is a credit reward system that offers users a 5% cashback credited to their ikoly account.

Customers have the opportunity to earn Airmoney as a reward for purchases conducted through specified payment methods.

Airmoney cannot be accrued when a discount or referral reward is utilized.

Airmoney can be utilized for purchases or combined with specific payment methods. However, its usage is not transferable between accounts.

6.1.4. REFUND PROCESS

To initiate a refund, please reach out to ikoly's support team and furnish the necessary information to support the refund request.

Refunds can be issued through the original payment method or credited as Airmoney to the account.

Refunds processed through the original payment method may take up to thirty (30) business days, while refunds credited as Airmoney are immediate.

6.2. MODIFICATION

eSIM data packages from ikoly are provided as-is, and no further alterations or customizations can be accommodated based on individual requests once purchased.

7. LIABILITY AND WARRANTY

ikoly is not liable for any adverse consequences resulting from the service intermittently not being available. There is no guarantee of uninterrupted availability of the network service by ikoly.
